MEMORANDUM OPINION AND ORDER

■ Jane Doe (“Doe”) is suing Environmental Auto Removal, Inc. (“EAR”) and one of its employees, Joseph Pantalena (“Pantale-na”), over events related to Doe’s arrest for disorderly conduct at the City of Chicago auto pound (“the pound”). 1 In count I of her six-count complaint, Doe alleges that Pantalena violated 42 U.S.C. § 1983 when he deprived her of her right to be free from unlawful seizure.
