I. Introduction and Procedural History

Plaintiff SMJ & J, Inc. (“SMJ & J”) filed a Complaint (Doc. 1) against Defendant NRG Heat & Power, LLC (“NRG”) seeking, inter alia, injunctive relief for NRG’s alleged violations of the Lanham Act, 15 U.S.C. § 1125(a), Pennsylvania Trademark Act, 54 Pa. Cons.Stat. § 1124, and for common law unfair competition. NRG counterclaimed (Doc. 5) under the *193Lanham Act and common law trademark infringement.
