STATEMENT OF THE CASE

Erie Insurance Exchange (“Erie”) appeals from the trial court’s denial of its motion for summary judgment and from the court’s grant of summary judgment in favor of Daryl Stephenson and Dawn Huser. This case arose when Huser was injured and filed a *609lawsuit against Stephenson who resided on the property where the accident occurred. Erie, the insurer, denied coverage to Stephenson and brought a declaratory judgment action.
