I. Introduction

Appellant, Lloyd Knotts, was seriously injured in a construction accident while performing construction work under a contract for a company. He initiated a claim with the company’s insurer and later filed *514a personal injury action against the company. He subsequently filed a bad-faith suit against the company’s insurer for violations of Kentucky’s Unfair Claims Settlement Practices Act (UCSPA).
