MEMORANDUM AND ORDER

NEALON, Chief Judge.

Presently before the Court is plaintiff’s second amended complaint and defendants’ motion to dismiss under Rule 12 of the Federal Rules of Civil Procedure. Supporting and opposing briefs have been filed, incorporating by reference supplemental briefs filed earlier in response to the Court’s memorandum and order of March 31, 1977. 1 Jurisdiction is asserted under 42 U.S.C. § 1983, and, therefore, under 28 U.S.C. § 1343.
