MEMORANDUM OPINION 1

On April 10, 1988, Theodore R. Paul (“Paul”) filed suit against Aubrey W. Glad stone (“Gladstone”) and National Leasing Corporation (“National”) in the Court of Common Pleas of Allegheny County. Dkt. No. 45, Stipulation of Facts (hereafter, “SOF”), ¶ 17. The Common Pleas Court entered judgment in favor of Paul, and against Gladstone and National on April 12, 1993, in the amount of $447,000.00 and the decision was affirmed by the Superior Court of Pennsylvania.
