delivered the opinion of the Court.-

Plaintiff in error, Roy Walden, aged thirty-six, hereinafter referred to as defendant, was indicted in the Criminal Court of Knox County on September 17, 1940', for the rape of Nancy Ruth Sorrell, a child eight and one-half years of age. He was put to trial on October 22, 1940, at the conclusion of which the jury returned a verdict of guilty and fixed the punishment at death by electrocution. A motion for a new trial was seasonably filed and presented which the trial court overruled and thereupon entered judgment in accordance with the verdict of the jury.…
