On January 17, 1996, this court dismissed the appeal of appellant, Joel Keith Tabor. Before us today is appellant’s motion to reinstate the appeal. The decision of the court on this motion is to remand this case to the trial court to “settle” the record. I must respectfully dissent because that course of action is procedurally defective and is in complete disregard of the law. However unfortunate the situation may be, the motion should be denied.
