Appeal from a judgment of the County Court of St. Lawrence County (Nicandri, J.), rendered February 24, 2003, upon a verdict convicting defendant of the crime of attempted assault in the second degree.

Defendant allegedly struck a correction sergeant in the face with his fist while being escorted in St. Lawrence County Correctional Facility, where he was an inmate. He signed a waiver of immunity and testified in front of the grand jury regarding the incident. He was thereafter indicted on one count of attempted assault in the second degree.
