The appellant took judgment by confession in the circuit court of Bureau county for $5,399.77 and cost, based on a note of $4,989.40. A motion was made by appellee to open up the judgment with leave to plead, which motion was allowed. Pleas were filed to the declaration and replications filed to the pleas and a trial was had and the issues were submitted to a jury and a verdict rendered for the appellee upon which judgment was rendered and from which ■ judgment this appeal is prosecuted.
