This was an appeal from an order of the Circuit Court refusing a motion of appellant to open a judgment by con-' fession against him in favor of appellee, and for leave to plead. From the affidavits filed in the cause it appears on November 19, 1895, appellant executed to one H. B. McGregor a certain promissory note, to settle some differences betwmen them arising out of transactions in grain; that before said note was due McGregor sold and assigned the same to appellee, who thereupon notified appellant that he had purchased the note, and was informed by appellant that the note was all right…
