This suit was brought by appellant to recover compensation for services rendered by him as agent for appel-lees in the sale of real and personal property belonging to appellees.
Omitting the formal parts and the description of the property alleged to have been sold by appellant for appellees, the petition is as follows: “That heretofore, to wit, on or about the 25th day of November, 1908, as copartners in business under the firm name and style of W.
