At issue in this contested proceeding is whether the private placement adoption of "Baby Girl S.” can be granted without the consent of her unwed father.

The prospective adoptive parents (Jane and Ed) contend that the consent of the father (Gustavo) is not necessary because he does not meet the criteria of Domestic Relations Law § 111 (1) (e).
