This matter comes before the Court on Defendants’ Motion to Dismiss (Doc. # 9), filed on February 24, 2011. This is a civil rights case. Plaintiff Alice Hawkins alleges that Defendants County of Bent, Colorado, and Barbara Martin violated rights granted to her by the Omnibus Budget Reconciliation Act of 1987 (“OBRA ’87”), which included the Federal Nursing Homes Reform Amendments (hereinafter, “FNHRA”).
