RANDOLPH, Circuit Judge:
For nearly a decade the Federal Communications Commission has attempted to restructure payphone compensation in compliance with the Telecommunications Act of 1996, Pub.L. No. 104-104, 110 Stat. 56. The 1996 Act required the Commission to “establish a per call compensation plan to ensure that all payphone service providers are fairly compensated for each and every completed intrastate and interstate call using their payphone[J” 47 U.S.C. § 276(b)(1)(A).
