In a libel action to recover damages alleged to have been caused by the defendant A. B. C. Carpet Company’s publication of an advertisement by the defendant-appellant in a newspaper published by the New York Post Corporation, said defendant Carpet Company appeals from an order of the Supreme Court, Nassau County, dated May 22, 1969, which denied its motion, made pursuant to rule 106 of the Rules of Civil Practice, to dismiss the complaint on the ground that it fails to state facts sufficient to constitute a cause of action. Order reversed, with $10 costs and disbursements, and motion granted…
