Textile Examiners and Shrinkers Employers’ Association, from an. interlocutory judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 1st day of -December, 1909, upon the decision of the court, rendered after a trial at the New York Special Term, overruling the defendant’s demurrer to the amended complaint. '

The plaintiff, as treasurer of an unincorporated' voluntary association consisting of' more than seven persons, brings this action to recover for damages alleged to have been sustained by reason of the publication of a libel in the form of a letter, dated July 23, 1909, sent to the Central Federated Union of New York City by the defendant corporation.
