— In a libel action, defendant appeals from an order of the Supreme Court, Nassau County (Spatt, J.), dated September 30, 1982, which denied defendant’s motion to dismiss the complaint for failure to state a cause of action. Order reversed, on the law, with costs, motion granted and complaint dismissed. On January 27,1981, defendant purchased a condominium from the plaintiff, the Hamlet Development Co.
