The case of John S. Owens et al. v. E. J. Hansen was tried on the 12th day of October, 1907, at the October, term of the superior court of Ben Hill county. The trial resulted in a verdict for the plaintiffs, and the defendant, being dissatisfied, on the 14th day of October and during the term .at which the verdict was rendered, made a motion for a new trial. On the same day, before the adjournment of the term, the court passed an order setting the hearing of said motion in vacation on the *8047th day of December, 1907.
