Defendant was convicted of theft in the first degree, ORS 164.055, burglary in the second degree, ORS 164.215, and criminal mischief in the first degree, ORS 164.354. The trial court merged the theft and burglary convictions and sentenced defendant to a 13-month incarceration term under ORS 137.717 (1997). The trial court also imposed a 13-month incarceration term under ORS 137.717 (1997) on defendant’s criminal mischief conviction. The court ordered the sentences to be served consecutively.
