This is an action to recover damages for personal injuries. It was instituted in the district court of Comanche county on the 4th day of January, 1940, by Luther C. Cann, as plaintiff, against T. J. Kelly, as defendant.
The injuries of which plaintiff complains were sustained while he was riding in a truck being driven by one John Pierce. The truck was being used to transport beer from St. Louis, Mo., to Lawton, Okla. At the time plaintiff received his injury it was traveling along Ü. S. Highway No. 66 toward Lawton at a point in Missouri about eight miles west of Springfield.
