These are cross appeals from a jury verdict and the judgment on it and from various intermediate rulings in an action seeking damages for personal injuries to the decedent, Edith Fogal, and derivative damages sustained by her husband, J ohn Fogal.

Edith Fogal was injured as the result of the use of a hypothermia blanket" to cool her body temperature during surgery. After exposure to the cold, Mrs. Fogal’s feet, thighs and buttocks became necrotic necessitating excision of parts of her legs and buttocks and amputation of parts of both feet.
