This case comes before the Court on Defendant/Trustee’s Motion to Dismiss Adversary Complaint for Failure to State a Claim Upon Which Relief can be Granted [the “Motion to Dismiss”] and Plaintiffs Cross Motion for Summary Judgment [the “Motion for Summary Judgment”].
