MEMORANDUM OPINION AND ORDER
REBECCA R. PALLMEYER, District Judge.
Plaintiff Earl S. Davis is a civilly committed detainee in the custody of the Illinois Department of Human Services (“DHS”). Since 1998, he has been housed in the DHS’s Treatment and Detention Facility (“TDF”) pursuant to the Sexually Violent Persons Commitment Act, 725 ILCS 207/1. In this suit, Davis claims that the conditions of his confinement violate his constitutional rights to equal protection and substantive due process.
