This action was brought to obtain a declaratory judgment which would establish the right of the plaintiffs to use the premises described as 159 Court Street in the village *561of Lancaster, New York, as a convalescent home. Injunctive relief was also sought. It appears that the plaintiff was advised by some of the village officials that a special permit for this particular use of their property would be required since it was ■ a business use in a residential zone. Accordingly, an application was made for a special permit and the board of trustees denied the application. The lawsuit that ensued…
