Wayne Adriance and Barbara Adriance appeal from a summary judgment entered in the Superior Court (Cumberland County, Mills, J.) in favor of the Town of Standish on their complaint seeking damages against the Town pursuant to the Maine Tort Claims Act (the Act), 14 M.R.SA. §§ 8101-8118 (1980 & Supp.1996). The Adriances contend that the court erred in concluding that certain acts and omissions by an attendant in the operation and maintenance of the Town’s waste transfer station were discretionary functions protected by the provisions of section 8104(B)(3) of the Act.
