The plaintiff appeals from a judgment in favor of the defendant, and from an order denying his motion for a new trial.

The first point made by the appellant is that the court erred in vacating a default entered against the defendant for her failure to answer the complaint. The action was commenced on September 29, 1906, and was brought to foreclose a lien upon defendant’s land for a balance alleged to be due upon a building contract.
