MEMORANDUM OPINION
MOON, District Judge.
This matter is before the Court on cross motions for summary judgment: Defendants’ Motion for Summary Judgment, filed on January 26, 2007 (docket entry no. 48) and Plaintiffs Motion for Summary Judgment, filed on January 28, 2007 (docket entry no. 51). For the reasons that follow, Defendants’ Motion for Summary Judgment will be granted in part and denied in part and Plaintiffs Motion for Summary Judgment will be denied, both in an order to follow.
