E. E. Whaley, defendant in error instituted this suit against D. D. McDonald and S. B. Edwards, plaintiffs in error, to. recover the sum of $3,000, paid in cash to the latter, and the value of an automobile delivered to them in connection with certain land transactions between the parties. A judgment, based upon special findings of the jury, in favor of defendant in error, was affirmed upon appeal. 228 S. W. 313.
