Now before the Court is a Motion for Summary Judgment by which Plaintiff Enzo Therapeutics, Inc. (“Enzo”), seeks early resolution of an Interference appeal filed pursuant to 35 U.S.C. § 146. Defendant Yeda Research and Development Co. (“Yeda”) objects to summary judgment and maintains that material facts remain in dispute that foreclose the premature termination or remand of this case to the Board of Patent Appeals and Interferences (“Board”) at the United States Patent and Trademark Office (“PTO”).
