Appellant, the state of Ohio, appeals from the decision of the Summit County Court of Common Pleas. We reverse.
On February 26, 1998, Robert L. Tipton, appellee, was indicted on ten counts. On August 11, 1998, Tipton was indicted on three more counts including one count of engaging in a pattern of corrupt activity, in violation of R.C. 2923.32(A)(1), and one count of conspiracy to engage in a pattern of corrupt activity, in violation of R.C. 2923.32(A)(1) and 2923.01.
