—Judgment unanimously affirmed. Memorandum: While in custody awaiting Grand Jury action on charges of criminal possession of a controlled substance in the third and fourth degrees, defendant consented to a 30-day extension of the statutory time period set forth in CPL 190.80 in order to continue to discuss a preindictment plea offer. The Grand Jury returned an indictment against defendant prior to the expiration of that 30-day extension, and the preindictment plea offer was no longer available.
