Petitioner Bro. R. Smallwood-El, pro se, appeals from the judgment of the United States District Court for the Western District of New York, Curtin, C.J., denying his motion for permission to proceed in forma pauperis and dismissing sua sponte his petition for a writ of habeas corpus for failure to exhaust state remedies as required by 28 U.S.C. § 2254(b) and (c).
