OPINION

ONION, Presiding Judge.

Both appellants were convicted in a joint trial of assault with intent to murder with malice. The jury then assessed their punishment at confinement in the Texas Department of Corrections for fourteen (14) years each.

On the morning of August 22, 1973, Texas Highway Patrolman Harold Ham-brick stopped a black 1973 Cadillac bearing Tennessee license plates for speeding. Officer Hambrick succeeded in stopping the car on Interstate 20 just inside the eastern city limits of Abilene.
