*873In an action, inter alia, to recover damages for personal injuries and property damage, the plaintiffs appeal from an order of the Supreme Court, Suffolk County (Werner, J.), dated May 18, 2005, which, in effect, denied as academic their motion for class action certification pursuant to CPLR article 9 and granted the defendant’s cross motion for summary judgment dismissing the complaint.
Ordered that the order is modified, on the law, (1) by deleting the provisions thereof granting that branch of the defendant’s cross motion which was for summary judgment dismissing so much of the complaint as…
