For the reasons set forth below, Plaintiffs Motion for Partial Summary Judgment [# 194] is DENIED. Defendant’s Motion for' Summary Judgment Nos. 1, 2, 3, 4, 5, 6, 7, and 8 [#185, #186, #187, #188, # 189, # 190, # 191, and # 192] are GRANTED.
