On September 29, 19.14, the Mammoth Copper Mining Company entered into a contract with Beer, Sondheimer & Co., dated August 24, 1914, reciting a consideration of “one dollar each to the other in hand paid * * * and the mutual terms and agreements” therein contained, whereby the former agreed to sell and deliver, and the latter to purchase and receive, “the total production of zinc crude ore shipped by the seller from its properties in Shasta county, California.” The buyer was not bound to accept any of the product running less than 33 per cent, metallic zinc,…
