Defendant, Levance McIntosh was arrested for unlawful use of weapons in violation of section 24—1(a)(4) of the Criminal Code of 1961 (Ill. Rev. Stat. 1975, ch. 38, par. 24—1(a)(4)). After a bench trial, the trial court found the defendant guilty as charged and sentenced him to two (2) days in custody, time considered served and one year nonreporting probation. Defendant also was assessed *45 in costs.
