Tn Equity. Suit by Alfred B. Beeves against Thomas J. Corning and Joseph I. Irwin to rescind a contract of sale of certain patents, and to recover possession of a note. Heard on demurrer to the complaint. ►Sustained as to the first paragraph, and overruled as to the second.

This action was commenced in the circuit court of Bartholomew county, Hid., on the 11th day of May, 1891. The state court ordered process against tho defendant Irwin to be issued to the sheriff of Bartholomew county, returnable September 29, 1891. Notice by publication was given to the defendant Coming, and was made returnable on tho same day. On the 23d day of September, 1891, the defendant Corning, a citizen of the state of Illinois, filed his verified petition for the removal of the cause from the state court into this court, on the ground of prejudice and local…
