The personal property which is the subject of this controversy was taken into the actual custody of the Circuit Court of the United States in the action of replevin by seizure under its writ of October 16, 1903. *653That seizure was lawful, and the jurisdiction of that' court over the property complete, unless the district court of Clark county then had plenary and exclusive dominion of the property in the Weldon suit.
