Introduction.
The Court has before it motions filed by creditor LC Associates (“LC”) and the United States Trustee (“UST”) which alternatively seek to dismiss or convert debtor Pen-signorkay, Inc.’s (“Debtor”) Chapter 11 bankruptcy case. More specifically, LC seeks: a) dismissal of the Debtor’s ease pursuant to § 1112(b)(1) and/or (2) of the United States Bankruptcy Code (“Code”), 11 U.S.C. §§ 101-1330; or alternatively, b) conversion of the ease to Chapter 7 and relief from the automatic stay under Code § 362(d)(1), (2) and/or (3), or adequate…
