2Per curiam

Edmond Boris Shell appeals the summary denial of his motion to withdraw his plea which this court has construed as a motion for post-conviction relief pursuant to Florida Rule of Criminal Procedure 3.850. We reverse.

At a combined plea and sentencing hearing held on May 23, 1985, Shell entered a negotiated nolo contendere plea to burglary and battery. The trial court sentenced Shell to five years imprisonment on the burglary and time…
