COLE, Circuit Judge.

A group of Tennessee citizens sued the Southeastern Boll Weevil Eradication Foundation (“Southeastern”), the Tennessee Boll Weevil Eradication Foundation (“Tennessee Foundation”), and various flying services and their respective employees, for allegedly spraying the insecticide malathion on their persons and properties. The plaintiffs asserted a claim under 42 U.S.C. § 1983 for violations of the Fourth, Fifth, Ninth, and Fourteenth Amendments.
