RULING ON THE DEFENDANT’S MOTION TO DISMISS

COVELLO, District Judge.

This is an action for damages in which the plaintiff, Philip Glynn, the beneficiary of an insurance policy, claims that the defendant, Bankers Life and Casualty Insurance Company (“Bankers Life”) wrongfully refused to make payments in accordance with the policy.
