MEMORANDUM AND ORDER

I. INTRODUCTION

This case arises out of an alleged fraudulent scheme at Lernout & Hauspie N.V. (“L & H”), a saga which has spawned a series of actions both against and on behalf of the bankrupt company. In this iteration, Plaintiff Scott L. Baena, Trustee of the L & H Litigation Trust, has filed an action against Defendants KPMG LLP (“KPMG US”) and Klynveld Peat Marwick Goerdeler Bedrijfsrevisoren (“KPMG Belgium”), L & H’s long-time auditors. 1 The complaint alleges that Defendants assisted L & H’s management in its elaborate scheme of accounting fraud…
