Appeal from Monroe county court. Action by James Dorsey against Bosella E. Pike for the price of machinery-sold. Defendant appeals from a judgment entered on a verdict for plaintiff,, and from an order denying a motion for a new trial.

The action was brought to recover the price of an engine,, boiler, and pump, with appendages, alleged to have been sold and delivered by the plaintiff to the defendant, and to have been purchased by her. The latter denied the sale and purchase. It appears that, the defendant was the; *731owner of a stone-quarry, in which she was engaged in quarrying stone for market; and that early in July, 1886, James B. Pike, the husband of the defendant, rented of the plaintiff this apparatus, to use in working the quarry, and it was put in use there for drilling and pumping. The plaintiff claimed, and gave…
