Hocker, J.:

On the 18th day of July, 1907, the defendants in error, whom we shall term the plaintiffs, *219brought an action of general assumpsit against the plaintiff in error, treated herein as the defendant, in the Circuit Court of Duval County.- The declaration and bill of particulars are as follows:

“Blair Burwell, Jr., and Charles. E.
