Florence Huntoon, the plaintiff appellant, brought her action in case against J. E. Pritchard, the defendant appellee, to recover damages on account of alleged malpractice on the part of said defendant. To this declaration the defendant interposed a plea to the effect that plaintiff’s sole remedy was under the Workmen’s Compensation Act, Cahill’s St. ch. 48, ¡I 201 et seq.
