Plaintiff, Ramon Lopez, a Connecticut inmate, brings this action primarily pursuant to 42 U.S.C. § 1983 against a number of correctional officers at the Northern Correctional Institution (“NCI”) in Som-ers, Connecticut. Mr. Lopez claims that Officer James Smiley assaulted him on August 31, 2001 and again on September 5, 2001, in violation of federal and state law.
