delivered the opinion of the court:
Plaintiff, Gordon Iverson, filed suit for divorce on the sole ground of mental cruelty. At the close of the plaintiff’s case the trial court allowed the plaintiff to amend his complaint by adding a paragraph containing specific allegations of mental cruelty and a separate paragraph alleging an attempt on the life of the plaintiff by the defendant by means showing malice. Immediately thereafter the trial court granted the defendant’s motion for a directed finding and dismissed the plaintiff’s amended complaint. In its memorandum…
